Terms of Service

The agreement between you and SEIS TECNOLOGIA, S.L. governing your use of the Trika app and services.

This Agreement also includes the Privacy Policy.

1 Acceptance of Terms

By downloading, installing, accessing, or using the Trika mobile application (the “App”), creating an account, or otherwise using any services provided through the App (collectively, the “Services”), you (“User”, “you”, or “your”) agree to be bound by these Terms of Service and the Privacy Policy that follows (together, the “Agreement”). If you do not agree, you must not use the Services.

This Agreement constitutes a legally binding contract between you and SEIS TECNOLOGIA, S.L., a company incorporated under the laws of Spain, with registered office at Calle Velázquez 24, 6º Izquierda, 28001 Madrid, España (“Trika”, “we”, “us”, or “our”).

We may amend this Agreement at any time. Material changes will be communicated through the App or by email at least thirty (30) days before they take effect, except where changes are required by law, in which case they may take effect immediately. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Agreement.

2 Eligibility

You must be at least sixteen (16) years old to use the Services, or the age of digital consent in your jurisdiction, whichever is higher. By using the Services you represent that you meet this requirement, that you have the legal capacity to enter into this Agreement, and that you are not barred from using the Services under any applicable law, regulation, or sanctions list. The Services are not directed at children under sixteen (16), and we do not knowingly collect personal data from them. If we become aware that we have collected such data, we will delete it promptly.

3 Account Registration and Security

To access the Services you must create an account. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update it; (c) keep your credentials confidential; and (d) accept responsibility for all activity that occurs under your account. You must notify us immediately at hello@seistech.es of any unauthorized access or breach of security. We may suspend or terminate your account if we have reasonable grounds to believe that the information you provided is inaccurate, that your account has been compromised, or that you have breached this Agreement.

4 Description of the Services

Trika is an AI-powered fitness and nutrition application that generates personalized training programs and meal plans from scratch based on each user's goal, context, biometric inputs, and ongoing evolution. Trika does not offer predefined programs. Instead, it constructs workouts dynamically for any sport, any level, and any goal — including but not limited to marathon preparation, powerlifting, sport-specific skill training (such as football, boxing, tennis, swimming, climbing), general fitness, weight management, hypertrophy, mobility, and recovery.

The Services include, without limitation: AI-generated training programs and nutrition plans; exercise demonstration content; macro and meal logging; integration with wearable devices and third-party platforms; workout history import; progress tracking; recovery and rest day suggestions based on biometric data; and proactive AI insights.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

5 Subscription, Free Trial, Billing, and Cancellation

5.1 Free Trial.

Trika offers a thirty (30) day free trial that activates automatically upon completion of onboarding. A valid payment method is required to start the trial. You will not be charged during the trial period. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

5.2 Subscription Plans.

We offer a single subscription tier with two billing cycles: monthly and annual. Pricing is disclosed at the point of purchase and may be updated. You authorize us, through the relevant app store (Apple App Store or Google Play Store), to charge the applicable fees to your selected payment method on a recurring basis until you cancel.

5.3 Auto-Renewal.

Subscriptions automatically renew at the end of each billing period at the then-current rate, unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period.

5.4 Refunds.

All purchases are final. Refunds, where applicable, are governed by the policies of the Apple App Store or Google Play Store from which you purchased the subscription. Where mandatory consumer protection laws apply (including, for EU/UK users, the right of withdrawal within fourteen days), you acknowledge and expressly agree that by accessing the Services during the free trial or upon subscription you request immediate performance, and you waive any right of withdrawal once the digital content has been supplied, to the extent permitted by law.

5.5 Price Changes.

We may change subscription prices at any time. Price changes will not apply to your current billing period and will be communicated in advance with at least thirty (30) days' notice. Continued use after the change constitutes acceptance.

5.6 Taxes.

Prices may exclude applicable taxes, which will be added where required by law.

6 License to Use the App

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. This license does not grant you any right to: (a) copy, modify, distribute, sell, lease, or sublicense any part of the Services; (b) reverse-engineer, decompile, or attempt to extract source code, except to the extent such restriction is prohibited by applicable law; (c) use the Services to build a competing product or to train any machine learning or AI model; (d) remove or alter any proprietary notices; (e) use any robot, scraper, or automated means to access the Services; (f) access the Services for the benefit of any third party, or resell or commercially exploit any part of the Services.

7 User Content and Data Submitted to the AI

The Services rely on inputs you provide, including but not limited to: goals, training history, free-text prompts, injury descriptions, dietary preferences, body measurements, photos (where uploaded), feedback, and biometric data ingested from connected wearables or third-party platforms (“User Content”).

7.1 Ownership.

You retain ownership of your User Content. You do not transfer ownership to us.

7.2 License to Trika.

You grant Trika a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, modify, create derivative works of, process, and transmit your User Content solely for the purposes of: (a) operating, providing, and improving the Services; (b) generating outputs for you (training programs, meal plans, insights); (c) maintaining safety and security of the Services; (d) complying with legal obligations; and (e) producing aggregated, anonymized, or de-identified data and statistics that cannot reasonably be used to identify you.

7.3 AI Model Training.

We do not use your identifiable personal data, health data, biometric data, photos, or free-text prompts to train third-party general-purpose foundation models without your explicit consent. Where we use aggregated and de-identified data internally to improve our own systems and quality, we do so in a manner that does not allow re-identification.

7.4 Responsibility for Inputs.

You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any law or any third party's rights. You agree not to upload User Content that is unlawful, infringing, harmful, defamatory, obscene, fraudulent, or that contains malware.

7.5 Free-Text Prompts and AI Outputs.

Free-text prompts you enter are processed by AI systems, including third-party large language model providers (such as OpenAI, Anthropic, and Google). By using the Services you acknowledge that your prompts and contextual data will be transmitted to these providers, subject to their data processing terms, and that AI outputs may be inaccurate, incomplete, or unsuitable for your circumstances. You must review AI outputs critically before acting on them.

8 Critical Health, Medical, and Safety Disclaimer

Important health & safety notice

The Services are not a medical device, are not intended to diagnose, treat, cure, or prevent any disease or health condition, and do not constitute medical, nutritional, psychological, or physiotherapeutic advice.

Trika provides general fitness and nutrition guidance generated by artificial intelligence. The Services are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any exercise or nutrition program, particularly if you (a) have a pre-existing medical condition (including but not limited to cardiovascular, musculoskeletal, metabolic, endocrine, neurological, or mental health conditions); (b) are pregnant, postpartum, or breastfeeding; (c) are taking medication that affects your physical performance or nutritional needs; (d) are recovering from injury or surgery; (e) have a history of disordered eating; (f) are under 18 years of age; or (g) are a high-performance or competitive athlete with specialized requirements.

Physical activity carries inherent risks, including but not limited to muscle strain, joint injury, fractures, cardiovascular events, heat-related illness, and, in rare cases, serious injury or death. By using the Services, you voluntarily assume all such risks. You agree that you are physically fit and have no medical condition that would prevent safe participation in the activities suggested by the Services, or that you have obtained clearance from a qualified healthcare professional.

If you experience pain, dizziness, shortness of breath, chest discomfort, faintness, or any other symptom during exercise, stop immediately and seek medical attention. Discontinue use of the Services and consult a healthcare professional if you have any concerns about your health.

Trika makes no representation or warranty that the AI-generated programs or meal plans are safe, appropriate, complete, or effective for your individual circumstances. You acknowledge that AI outputs may contain errors, omissions, or recommendations that are unsuitable for you, and that you alone are responsible for evaluating and acting on them.

9 Wearables and Third-Party Integrations

The Services may integrate with third-party platforms and devices, including Apple Health/HealthKit, Google Health Connect, Garmin Connect, Apple Watch, Wear OS devices, Whoop, Strava, Strong, and others (“Third-Party Services”). Your use of Third-Party Services is governed by their own terms and privacy policies, which you are responsible for reviewing.

We are not responsible for the accuracy, availability, or reliability of Third-Party Services or the data they provide. If you grant authorization to connect a Third-Party Service, you authorize us to access, receive, store, and process the data made available through that integration. You may revoke these permissions at any time through the App's settings or through the Third-Party Service.

10 Prohibited Conduct

You agree not to: (a) use the Services for any unlawful purpose; (b) circumvent or attempt to circumvent any security or access control mechanism; (c) reverse-engineer, scrape, or attempt to extract the prompts, system instructions, or model behavior of the AI; (d) use the Services to harass, harm, defraud, or impersonate any person; (e) submit false or misleading health information that could affect the Services' guidance to others; (f) create multiple accounts to circumvent the trial period or abuse promotional offers; (g) share your account credentials; (h) interfere with the operation of the Services or the experience of other users; (i) use the Services in jurisdictions where they are not lawfully available; (j) use the Services to provide professional coaching, training, or nutrition services to third parties without our written authorization.

11 Intellectual Property

All intellectual property rights in the Services — including software, the App, AI models and outputs (other than your User Content and outputs that incorporate it), trademarks, logos, designs, text, graphics, and exercise demonstration content (which may be licensed from third parties such as ExerciseDB) — are owned by Trika or its licensors and are protected by intellectual property laws. Nothing in this Agreement transfers any such rights to you, other than the limited license expressly granted.

The names “Trika” and any associated logos are trademarks of Trika. You may not use them without our prior written consent.

12 Feedback

If you submit suggestions, ideas, or feedback about the Services, you grant Trika a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use them for any purpose without attribution or compensation.

13 Disclaimers and Warranty Limitations

“As is” — no warranties

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or that the Services will be uninterrupted, secure, or error-free.

We make no warranty that the AI outputs will be accurate, complete, current, suitable, or safe for your particular circumstances. We make no warranty that the Services will help you achieve any specific result, including weight, performance, body composition, or health outcome.

Nothing in this Agreement limits or excludes warranties or rights that cannot be limited or excluded under applicable law (including statutory consumer rights under EU/UK/EEA law).

14 Limitation of Liability

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Trika, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of, or inability to use, the Services — including without limitation any injury, illness, or harm resulting from reliance on AI-generated recommendations.

To the maximum extent permitted by law, our aggregate liability for all claims arising out of or related to the Services in any twelve (12) month period shall not exceed the greater of (a) the total fees you paid to Trika in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100).

Nothing in this Agreement limits or excludes any liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by our gross negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded under mandatory consumer protection law.

15 Indemnification

You agree to indemnify, defend, and hold harmless Trika and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Services; (c) your breach of this Agreement; (d) your violation of any law or third-party right; (e) any injury, illness, or harm you suffer as a result of relying on AI outputs without independent verification.

16 Termination

You may terminate this Agreement at any time by deleting your account through the App. We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have breached this Agreement, or if required by law. Upon termination: (a) your right to use the Services ceases immediately; (b) your data will be retained or deleted as described in the Privacy Policy; (c) sections that by their nature should survive termination will survive, including Sections 7 (license to Trika), 8 (health disclaimer), 11 (IP), 12 (feedback), 13–15 (disclaimers, liability, indemnification), 17–19 (governing law, disputes, miscellaneous).

17 Governing Law

This Agreement is governed by the laws of Spain, without regard to its conflict of laws principles. For consumers domiciled in the European Union, the United Kingdom, or any other jurisdiction with mandatory consumer protection laws, the application of such mandatory laws is not affected by this provision.

18 Dispute Resolution

18.1 Informal Resolution.

Before initiating any formal proceeding, you agree to contact us at hello@seistech.es and to attempt to resolve the dispute informally for at least sixty (60) days.

18.2 Jurisdiction.

Subject to any mandatory rights you may have as a consumer to bring proceedings in the courts of your place of residence, any dispute arising out of or relating to this Agreement shall be brought exclusively in the competent courts of Madrid, Spain.

18.3 EU Online Dispute Resolution.

EU consumers may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

18.4 Class Action Waiver.

To the extent permitted by applicable law, you and Trika agree that disputes shall be resolved only on an individual basis and not as part of any class, consolidated, or representative action.

19 Miscellaneous

Entire Agreement. This Agreement is the entire agreement between you and Trika and supersedes all prior agreements. Severability. If any provision is found unenforceable, the remaining provisions remain in effect. No Waiver. Our failure to enforce any provision is not a waiver. Assignment. You may not assign your rights under this Agreement without our consent. We may assign ours freely, including in connection with a merger, acquisition, or sale of assets. Force Majeure. We are not liable for any failure caused by events beyond our reasonable control. Apple App Store / Google Play Store Terms. If you obtained the App through the Apple App Store or Google Play Store, additional terms apply. Apple Inc. and Google LLC are not parties to this Agreement and are not responsible for the App or its content; however, they are third-party beneficiaries entitled to enforce this Agreement against you.
